The Paralegal Specialist:
GS-9 Responds to general inquiries from awardees on intellectual property related forms associated with financial assistance, reviews IP-related forms, and Intellectual Property Law Division requests for completeness and significant issues; maintains accurate and complete dockets for patent attorneys regarding IPLD requests, National Renewable Energy Laboratory requests, patent waivers, and other IP activities; Assists patent attorneys when needed on IP-related litigation and patent preparation and prosecution matters. Analyzes and evaluates case files against case litigation worthiness standards, noting and correcting case file deficiencies, including but not limited to missing documents, inconsistent materials, and leads not investigated, before sending the case on to the concerned attorney. Reviews and analyzes available precedents relevant to cases under consideration for use in presenting case summaries to attorneys. Gathers, sorts, classifies, and interprets data obtained from various sources, such as case reports, statutes, regulations, and legislation that have a bearing on legal issues relating to DOE and office activities. Conducts transactional duties in support of attorneys carrying out financial assistance, procurement, human resources, laboratory oversight and general law duties for the office. Assists the Ethics Official in managing and processing employee annual mandatory confidential financial disclosure forms. GS-11 Organizes and maintains intellectual property-related documents pertaining to financial assistance awards and oversight of the National Renewable Energy Laboratory. Communicates with agency headquarters IP office and awardees regarding status of IP-related matters, including patent waivers Analyzes, investigates, identifies issues, determines the best approach, and recommends appropriate course of action for cases to the Chief Counsel or other designated attorney(s). Performs extensive research related to cases assigned, including reviewing Comptroller General decisions, legislative histories, and precedential court cases. Reviews all investigative materials compiled and in conjunction with attorneys, meets/interviews claimants, potential witnesses, DOE officials, members of the public witnesses for depositions, and conducts on-site investigations, analyzing fact and evidence developed while evaluating claims, telephonically or in person. Consults with other Federal State and local agencies regarding the Federal Tort Claims Act or other legislations, as well as regulations and related cases and requests. Prepares litigation reports in connection with lawsuits filed against the agency. Collects facts from relevant parties and prepares various affidavits. Assists with all aspects of administrative and other litigation including but not limited to, document production, discovery, and motions drafting and filing. Monitors the Federal Public Access to Court Electronic Records system and files legal documentation. Coordinates related lawsuits and litigation with staff attorneys of other departments. Provides paralegal support to staff attorneys in the areas of general law, tort claims, intellectual property (IP), and ethics; completes detail-oriented work requiring research, writing, and analytical skills to finalize documents; uses discretion and independent judgment in the application of specialized knowledge to provide services to the legal office; assists with fulfilling requests under the Freedom of Information Act (FOIA); and assists in the awarding of financial assistance. Reconciles contradictory procedures and determines the underlying issue; defining the issue relating to the applicable laws, deciphering substantial data and considering facts to formulate a legally and factually substantial standpoint. The check can be for multiple reasons such as signing bonus, supplies, etc. The victim will be instructed to deposit the check and use the money for any of these reasons and then instructed to send the remaining funds to the fraudster. The check will bounce and the victim is left responsible.
